Session 1 – What is the colour of my FIDIC Rainbow?

An introduction to the FIDIC Rainbow (Red/Yellow/Silver Books), the 1999/2017 editions, historical development and principles of these forms, the concept of an “Engineer” driven contract administration structure, condition precedents, Engineer’s determination, Employer’s financial arrangement, unexpected risks, errors in contract documents, and related case laws on interpretation of FIDIC contract provisions.

Session 2 – Is FIDIC that different from PAM/JKR Forms?

Key FIDIC contract clauses compared and contrast with PAM/JKR contract provisions on payment, variations, extension of time and delay damages. Contractor’s obligations and liabilities, force majeure, additional non-FIDIC “catch-all” contractor’s liabilities provisions commonly included in international construction contracts. The Dispute Adjudication/Avoidance Board (DAB/DAAB) procedure, and its interaction with arbitration/litigation and statutory adjudication under CIPAA 2012.

Session 3 – A FIDIC contract, or a Hybrid Monster?

FIDIC General Conditions, Particular Conditions and Special Provisions of Contract. Typical bespoke amendments to the FIDIC Conditions. Order of priority of contract documents and rules of interpretation. Examples of possible ambiguity in interpretation due to introduction of bespoke contract provisions. Guidance on contract administration of complex contract forms, templates for Clause 20.1 notices and claims, Confirmation of Verbal Instruction, Change Orders and Request for Information.

Session 4 – FIDIC clauses with timelines, where do I begin? ( A Workshop)

A workshop on numerous FIDIC provisions where there are strict timeline compliance requirements, including a claim for payment and/or time, time bar for claims, challenges to instructions, Engineer’s determination on both Contractor’s and Employer’s claims, notice of dissatisfaction, replacement of the Engineer, programme submission and advance warning provisions, and guidance on the standards of submission expected from contractors on claims.

About The Speaker

Mr Soh Lieh Sieng is a consummate construction industry expert, having spent some 28 years working for contractors, consultants and employers throughout the United Kingdom, Europe, Asia Pacific and the Middle-East in engineering, construction and dispute resolution roles. Over the years Lieh Sieng has developed skills in project management, construction of major bridges and infrastructure works, airports and buildings, power plants, oil/gas construction and heavy-lift operations, contract administration, preparation of claims related to changes and variations, delays and extension of time (EOT), and loss and expense claims in respect of delays, disruption and acceleration.

Currently working in Malaysia, Singapore and the region, Lieh Sieng specialises in resolving construction and contractual disputes, and regularly acts as Expert Witness for contractors or employers in court, adjudication and arbitration. Lieh Sieng has presented written and oral expert evidence on cases in relation to construction technology, defective works, contract termination, delay and extension of time, loss and expense, variations, cardinal change and contract interpretation in both domestic and international proceedings under ICC, AIAC and SIAC arbitration rules.

Lieh Sieng is known for his extensive knowledge in the use of the FIDIC EPC and Design/Build Contract Forms where he has spent many years advising parties to infrastructure and power generation projects in several developing countries, as well as assisting parties in resolving disputes under FIDIC’s Dispute Adjudication Board (DAB) procedure and International Chamber of Commerce (ICC) Arbitration proceedings.

Lieh Sieng holds qualifications in both Civil Engineering and Law. A UK qualified Chartered Building Engineer, Chartered Surveyor, Chartered Construction Manager, Accredited NEC3 Project Manager and Certified Cost Engineer, he is a Fellow of the Royal Institute of Chartered Survyeors UK, the Chartered Institute of Building UK, the Chartered Institute of Arbitrators UK, the Chartered Association of Building Engineers UK, the Association of Cost Engineers UK, the Singapore Institute of Arbitrators, the Malaysian Institute of Arbitrators, the Malaysian Society of Adjudicators and the Asian Institute of Alternative Dispute Resolution. He is also an Accredited Expert and a Fellow of the Academy of Experts UK, the professional body for expert witnesses worldwide.

ABOUT THE CO-SPEAKER

EDWARD LEE - ACCREDITED EXPERT, ADJUDICATOR & ARBITRATOR

Edward started his professional career as a Post-Contract Executive back in 1994 with a Civil Engineering Contractor working on major infrastructure projects such as dam construction, water works, marine reclamation and railway track works.

With his 25 years’ working experience in major infrastructure works, Edward joined CSi as a Partner in 2018, to enable him to focus on his interest in resolving construction disputes. He currently leads CSi’s dispute management group in providing management of adjudication and arbitration matters, claims consulting and litigation support.

Edward is qualified in Quantity Surveying and Law. A Chartered Quantity Surveyor of the Royal Institute of Chartered Surveyors UK, a Panel Arbitrator of the Asian International Arbitration Centre (AIAC), the Thailand Arbitration Center, the Hainan International Arbitration Court and the Chartered Institute of Arbitrators Business Arbitration Scheme, he is a Fellow of the Chartered Institute of Arbitrators UK, the Asian Institute of Alternative Dispute Resolution, a Fellow of the Malaysian Society of Adjudicators and an accredited Expert of the Academy of Experts UK. He is certified to act as Adjudicator for statutory adjudication under the Construction Industry Payment and Adjudication Act (CIPAA) in Malaysia. 

Edward is also a speaker and trainer for in-house training programmes, conducting courses for in-house certification in relation to CIPAA and other related construction contract topics. He holds the position of Honorary Treasurer of the Malaysian Society of Adjudicators (2020-Present).

Miss Wong Jian Bei graduated from the National University of Singapore with a degree in Project and Facilities Management in 2012, and began her career in facilities management at the landmark Gardens by the Bay, Singapore. Subsequently she moved into the field of construction scheduling with Sinohydro, where she developed experience in construction management & scheduling.

Jian Bei leads CSi’s Forensic Planning & Delay Services in our Kuala Lumpur office. Her recent appointments include acting as expert witness on delay for the external works of a power plant project, and a Malaysia Government water supply project, as well as advisor to parties on on-going buildings and infrastructure projects.
